Dabrowskiego 139<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><strong><a href=\"https:\/\/hoteldabrowski.pl\/wp-content\/uploads\/2024\/12\/SOM.pdf\">Download full regulations<\/a><\/strong><\/p>\n<p><\/br><\/p>\n<h5><strong>1.DEFINITIONS<\/strong><\/h5>\n<p><\/br><br \/>\nFor the purposes of this document, the meaning of the following terms has been clarified:<\/p>\n<ul>\n<li>A child\/minor is any person under 18 years of age, including disabled children and<br \/>\nwith children with special educational needs.<\/li>\n<li>An adult stranger is any person over the age of 18 who is not a relative of the child.<br \/>\nparent or legal guardian.<\/li>\n<li>\u00a0Harming a child means committing a crime against the child.<\/li>\n<li>Crime against a child - all crimes against children can be committed<br \/>\ncrimes that can be committed against adults, and additionally<br \/>\ncrimes that can only be committed against children (e.g. child abuse)<br \/>\nsexual under Article 200 of the Penal Code). Due to the specific nature of tourist facilities, where it is easy to<br \/>\nto obtain the possibility of isolation, crimes that can most often occur on their<br \/>\nthere will be crimes against freedom (Art. 189 of the Penal Code, Art. 189a of the Penal Code and Art. 191a of the Penal Code),<br \/>\nagainst sexual freedom and decency, in particular rape (Article 197 of the Penal Code),<br \/>\nsexual exploitation of insanity and helplessness (Article 198 of the Penal Code), sexual exploitation<br \/>\ndependency or critical situation (Article 199 of the Penal Code), sexual exploitation of a person under 15<br \/>\nyears of age (Article 200 of the Penal Code), grooming (seduction of a minor by means of<br \/>\ncommunication at a distance \u2013 Art. 200a of the Penal Code), as well as offences concerning the violation<br \/>\nphysical integrity (Article 217 of the Penal Code).<\/li>\n<li>Other forms of harm to a child than committing a crime against him\/her \u2013 all<br \/>\nforms of violence against a child that do not meet the criteria for a prosecutable crime<br \/>\nby public accusation (e.g. shouting, humiliation, pulling, insulting, neglecting needs,<br \/>\ne.t.c.).<\/li>\n<li>An employee is a person employed under an employment contract or performing work on the basis of<br \/>\na similar contract (e.g. contract of mandate, B2B, contract for specific work), as well as a trainee, apprentice,<br \/>\nvolunteer etc.<\/li>\n<\/ul>\n<p><\/br><\/p>\n<h5><strong>2.PREAMBULE<\/strong><\/h5>\n<p><\/br><br \/>\nTaking into account the content of the United Nations Guidelines on Business and Human Rights<br \/>\nRecognizing the important role of business in ensuring respect for children&#039;s rights, in particular<br \/>\nthe right to protect their dignity and freedom from all forms of harm, Hotel D\u0105browski accepts<br \/>\nthis document as a model for rules and procedures in the event of a suspicion that a child who is in<br \/>\nHotel D\u0105browski is being wronged. This document is also adopted for the purpose of preventing<br \/>\nany threats to children.<br \/>\nWe will implement our hotel child protection policy through the following principles:<\/p>\n<ul>\n<li>\u00a0Hotel D\u0105browski conducts its operations with the utmost respect for human rights.<br \/>\nhuman rights, in particular the rights of children as people who are particularly vulnerable to harm.<\/li>\n<li>Hotel D\u0105browski recognizes its role in running a socially responsible business and<br \/>\nPromoting desirable social attitudes.<\/li>\n<li>\u00a0Hotel D\u0105browski particularly emphasizes the importance of legal and social obligations<br \/>\nnotifying law enforcement agencies of any suspected crime committed<br \/>\nharm to children and undertakes to train its staff in this regard.<\/li>\n<li>\u00a0Hotel D\u0105browski is committed to educating staff about circumstances that indicate that<br \/>\na child staying in the facility may be harmed and in terms of how to quickly<br \/>\nand appropriate response to such situations.<\/li>\n<li>\u00a0One of the effective ways to prevent child abuse is to identify the child<br \/>\nstaying in the facility and his\/her relationship to the adult with whom he\/she is staying in the facility.<br \/>\nThe staff takes all possible steps to identify the child.<br \/>\nand his relationship with the adult with whom he is in the facility, based on a procedure clearly defined<br \/>\nprinciples and good practice.<\/li>\n<\/ul>\n<p><\/br><\/p>\n<h5><strong>3. RULES FOR ENSURING SAFE RELATIONS BETWEEN HOTEL STAFF<\/strong><br \/>\n<strong>D\u0104BROWSKI, AND MINORS, IN PARTICULAR PROHIBITED BEHAVIORS TOWARDS<\/strong><br \/>\n<strong>MINORS<\/strong><\/h5>\n<p><\/br><\/p>\n<ul>\n<li>All people working with children must be safe for them, which means, among other things, that their<br \/>\nemployment history should indicate that they have not harmed any child in the past.<\/li>\n<li>\u00a0Every person employed by Hotel D\u0105browski for work related to education, recreation and<br \/>\nchildcare, including people employed under an employment contract or a civil law contract,<br \/>\nan intern, trainee or volunteer, regardless of the nationality and age of that person1<br \/>\nit is mandatory to check the Sex Offenders Register<br \/>\n(https:\/\/rps.ms.gov.pl\/). Each time, the HR department before the employee signs the contract<br \/>\ndelegated to the above activities verifies his personal data in the register. Printout<br \/>\nis placed in the personal file of the person being checked. Verification is repeated every year.<\/li>\n<li>\u00a0All employees employed to work with children must submit a declaration of lack of<br \/>\ncriminal record and no proceedings pending for acts against children.<\/li>\n<\/ul>\n<p>In case of using the services of external entities, this must be included in the contract with that entity<br \/>\na record of this entity&#039;s declaration with the entity&#039;s obligation to obtain its consent<br \/>\nemployees, which will give Hotel D\u0105browski a real possibility of enforcing<br \/>\nan appropriate standard for checking employees by this entity in terms of their<br \/>\nsafety for children. Such a provision should assume the possibility of checking the fulfillment of the obligation, e.g.<br \/>\nunder penalty of immediate termination of the contract and contractual penalty. Each person employed<br \/>\nby a subcontractor, and the person working with children is obliged to present a printout from the &quot;Register<br \/>\nPerpetrators of Sexual Crimes.\u201d<\/p>\n<ol>\n<li>Employers and organizers of activities related to the upbringing, education, recreation, treatment or care of children have<br \/>\nobligation (Article 21) to check whether the data of the person employed or admitted to the activity are in the Register. Failure to do so<br \/>\nthe obligation is punishable by arrest, restriction of freedom or a fine of not less than PLN 1,000 (Article 23). (Act of 13 May 2016<br \/>\non counteracting threats of sexual crime (Journal of Laws of 2023, item 1304).)<\/li>\n<li>&quot;The company \u2026\u2026\u2026\u2026\u2026\u2026 guarantees that the staff employed by it meets all standards related to the safety of children in<br \/>\nin connection with the performance of tasks resulting from the agreement. In order to verify the above assurance, the company \u2026\u2026\u2026\u2026. undertakes to obtain<br \/>\nconsents of its employees for the benefit of Hotel D\u0105browski in order to enable Hotel D\u0105browski to fulfill the above-mentioned obligation.\u201d<\/li>\n<\/ol>\n<p><\/br><\/p>\n<h5><strong>4. RULES AND PROCEDURES FOR IDENTIFYING A MINOR STAYING IN THE FACILITY<\/strong><br \/>\n<strong>HOTEL MANAGEMENT AND HIS RELATIONSHIP TO THE ADULT WITH WHOM HE IS STAYING IN<\/strong><br \/>\n<strong>IN THIS OBJECT<\/strong><\/h5>\n<p><\/br><\/p>\n<p>If the reservation includes a request for a child to stay, the receptionist is obliged to<br \/>\ncheck-in of all persons who are in the room with the child by filling out<br \/>\nindividual registration cards. The person who is the child&#039;s guardian is obliged to<br \/>\ncompleting the child\u2019s data and the degree of relationship on the registration card.<br \/>\nIf the child&#039;s guardian is not a legal guardian, the receptionist cannot check in guests.<br \/>\nhotel premises until the degree of relationship is clarified or consent is obtained<br \/>\nthe child&#039;s stay from the legal guardian. The receptionist should inform the child about the situation<br \/>\ninform your immediate superior immediately. Please remember that<br \/>\ngrandparents, in the case of parents having full parental rights, are not<br \/>\nlegal guardians in the light of the understanding of the Family and Guardianship Code and the justified<br \/>\nit is important that they have parental consent in relation to the above situation, unless otherwise determined<br \/>\nrelationship and the child&#039;s behavior raise no doubts.<\/p>\n<p><\/br><\/p>\n<h5><strong>5. RULES AND PROCEDURES FOR RESPONDING IN THE EVENT OF REASONABLE ASSUMPTION THAT<\/strong><br \/>\n<strong>THE WELL-BEING OF A MINOR PERSON STAYING ON THE PREMISES OF THE HOTEL D\u0104BROWSKI FACILITY IS<\/strong><br \/>\n<strong>ENDANGERED<\/strong><\/h5>\n<p><\/br><\/p>\n<p>Any employee who has reasonable suspicion that a child staying at the Hotel facility<br \/>\nD\u0105browski is being wronged, he is obliged to inform his immediate superior, who<br \/>\ndecides on personal reaction and contact with the Police depending on the dynamics of the situation and<br \/>\ncircumstances.<br \/>\nThere is reasonable suspicion of child abuse when:<br \/>\na. The child disclosed the abuse to a facility employee.<br \/>\nb. The employee observed the abuse.<br \/>\nc. The child shows signs of abuse (e.g. scratches, bruises) and when asked, answers<br \/>\ninconsistent and\/or chaotic and\/or confused or other circumstances occur<br \/>\nthat may indicate harm, e.g. finding pornographic materials with<br \/>\nparticipation of children in an adult&#039;s room.<br \/>\nd. There are disturbing sounds of harm\/possible harm coming from the hotel room.<br \/>\nor child abuse.<br \/>\ne. An adult has observed disturbing behaviour towards the child (also with<br \/>\nusing CCTV).<br \/>\nIn a situation of escalating tensions between an adult suspected of causing harm<br \/>\nchild or about unclear relationships with a child, the first thing to do is to:<br \/>\na. Ensuring your own safety.<br \/>\nb. Ensuring the safety of the child.<br \/>\nc. Inform the intervention patrol.<br \/>\nd. De-escalate tensions and conduct a calm conversation.<\/p>\n<p><\/br><\/p>\n<h5><strong>6. HOTEL STAFF RULES OF CONDUCT IN THE FIELD OF VIOLENCE AGAINST CHILDREN<\/strong><br \/>\n<strong>DISABLED OR WITH SPECIAL EDUCATIONAL NEEDS<\/strong><\/h5>\n<p><\/br><\/p>\n<p>a. Hotel D\u0105browski undertakes to regularly educate staff on how to serve children<br \/>\ndisabled or with special educational needs.<br \/>\nb. As part of training, staff should become familiar with the rules of conduct<br \/>\ntowards a disabled child whose behaviour on the hotel premises may indicate,<br \/>\nthat he\/she is experiencing violence from a parent\/guardian.<br \/>\nc. Recognizing signs of abuse towards disabled minor hotel guests<br \/>\nis an extremely difficult task. Hotel employees usually do not have knowledge of<br \/>\nabout the type of disability of the minor guest, the behavioral model<br \/>\ncharacterizing a person with a given disability and the specifics of his\/her individual<br \/>\nrelationship with the parent\/guardian. A significant factor that makes it difficult to indicate symptoms,<br \/>\nwhich may indicate that the child is being harmed, is the time of contact of the employee<br \/>\nwith a minor while performing official duties.<br \/>\nd. However, they should pay special attention to the tasks they perform, just as<br \/>\nin the case of able-bodied minor guests:<br \/>\n1. visible bodily injuries (bruises, burns, bites, etc.)<br \/>\nthe origin is difficult to explain, the injuries are in different stages of healing,<br \/>\n2. unreliability and inconsistency of the explanations given by the child regarding<br \/>\ninjuries,<br \/>\n3. anxiety visible during the child&#039;s contact with a parent\/guardian or another person<br \/>\nadult, phobias,<br \/>\n4. somatic complaints (abdominal pain, headache, vomiting, nausea),<br \/>\n5. isolating yourself from other people, especially parents\/guardians,<br \/>\n6. depressive symptoms, self-harm, suicidal thoughts,<br \/>\n7. inconclusive or contradictory information or refusal to explain the reasons<br \/>\ninjuries to a child by a parent\/guardian,<br \/>\n8. constant humiliation, insulting of the child by the parent\/guardian, use of<br \/>\nno pejorative terms, vulgarisms,<br \/>\n9. exceeding the parent&#039;s\/guardian&#039;s acceptable limits in physical contact<br \/>\nwith a child,<br \/>\n10. disturbed contact of the parent\/guardian with reality, e.g. reacts<br \/>\ninappropriate to the situation, speaks incoherently and in other disturbing ways,<br \/>\nunusual behavior.<br \/>\ne. A hotel employee who, while performing his\/her duties,<br \/>\nobserves disturbing behaviour in relation to the child and\/or his\/her<br \/>\nparent\/guardian, should immediately forward it to their immediate<br \/>\nsuperior.<\/p>\n<p><\/br><\/p>\n<h5><strong>7. PROCEDURES AND PERSONS RESPONSIBLE FOR SUBMITTING NOTIFICATIONS OF SUSPICION<\/strong><br \/>\n<strong>COMMITTING A CRIME TO THE DAMAGE OF A MINOR AND NOTIFYING THE COURT<\/strong><br \/>\n<strong>CARING<\/strong><\/h5>\n<p><\/br><\/p>\n<p>In every case where there is a suspicion of a crime being committed or when a crime has been committed<br \/>\ncrimes, the Owners of the D\u0105browski Hotel are obliged to cooperate with law enforcement agencies and<br \/>\nsubmitting appropriate notifications.<br \/>\nIn the event of situations not described in this procedure, each employee should<br \/>\nbe guided primarily by your own safety, the well-being of your child and other good<br \/>\npractices.<\/p>\n<p><\/br><\/p>\n<h5><strong>8. SCOPE OF COMPETENCE OF THE PERSON RESPONSIBLE FOR PREPARING THE HOTEL STAFF<\/strong><br \/>\n<strong>D\u0104BROWSKI FOR THE APPLICATION OF STANDARDS. RULES FOR PREPARING THIS STAFF FOR THEM<\/strong><br \/>\n<strong>APPLICATION AND METHOD OF DOCUMENTING THIS ACTIVITY<\/strong><\/h5>\n<p><\/br><\/p>\n<ul>\n<li>\u00a0The owners of the Hotel D\u0105browski supervise the application of the Child Protection Policy.<\/li>\n<li>\u00a0The owners of the Hotel D\u0105browski are also coordinators for the Child Protection Policy (in<br \/>\n(hereinafter referred to as the &quot;Coordinator&quot;).<\/li>\n<li>The coordinator is responsible for familiarizing employees with the content of the Child Protection Policy.<br \/>\nand monitoring its use in the Hotel D\u0105browski. The coordinator organizes and documents<br \/>\nthe process of educating employees on recognizing symptoms that occur in the facility<br \/>\na child may be harmed and how to respond quickly and appropriately to such<br \/>\nsituations, in accordance with the procedures adopted by the facility.<\/li>\n<li>\u00a0The coordinator describes each intervention or reported incident involving child abuse on<br \/>\nin the facility in a document created for this purpose (e.g. event log or register<br \/>\nintervention).<\/li>\n<li>\u00a0In the event of a reasonable suspicion that a crime has been committed, the Coordinator is<br \/>\nresponsible for securing evidence, including surveillance recordings, and forwarding them to<br \/>\nrequest from the services in the form of a copy by registered mail or in person to the prosecutor or police.<\/li>\n<li>\u00a0The coordinator is responsible for conducting the procedure in a situation where harm has occurred.<br \/>\na child by a facility employee or other adult who is not directly employed<br \/>\nby Hotel D\u0105browski but by a third party.<\/li>\n<li>\u00a0The Coordinator is responsible for monitoring and updating the Child Protection Policy and their<br \/>\navailability among both employees and other entities cooperating with the facility and<br \/>\nguests.<\/li>\n<li>\u00a0The coordinator&#039;s details are available to all employees and guests of the facility, including children.<br \/>\nmust include information on how to contact the Coordinator (e-mail address,<br \/>\ntelephone, availability: days and hours of operation).<\/li>\n<li>The name and surname and details of the Coordinator are included in the internal procedure and are available<br \/>\nfor entities auditing and controlling Hotel D\u0105browski in the scope in question and for<br \/>\nlaw enforcement authorities as part of ongoing proceedings.<\/li>\n<li>The persons responsible for implementing and complying with this procedure at the Hotel D\u0105browski<br \/>\nare the owners of the facility.<\/li>\n<li>\u00a0Employees employed under the UoP and UCP sign an annex to the contract, which confirms<br \/>\nfamiliarization with the procedure. Persons supervising subcontractors&#039; employees are obliged to provide information<br \/>\nabout the scope of this procedure.<\/li>\n<\/ul>\n<p><\/br><\/p>\n<h5><strong>9. CYCLIC AUDIT OF IMPLEMENTED SECURITY STANDARDS<\/strong><\/h5>\n<p><\/br><\/p>\n<p>Evaluation of implemented safety standards and their possible update to the applicable ones<br \/>\nlegal provisions will be carried out periodically at least once every two years by the owners of the Hotel<br \/>\nD\u0105browski A report with conclusions will be prepared from each audit carried out<br \/>\npost-control.<\/p>\n<p><\/br><\/p>\n<h5><strong>10.HOTEL SIGNAGE<\/strong><\/h5>\n<p><\/br><\/p>\n<p>Information about the standards for child protection applicable at the Hotel D\u0105browski can be found here<br \/>\nin the public areas of the hotel and in information folders located in the rooms<br \/>\nhotel.
